Today, the Supreme Court heard oral argument in the Little Sisters of the Poor's legal challenge to the ObamaCare requirement that non-church religious organizations must provide contraceptive and abortion-inducing drugs and devices at no cost to employees.
During the 90-minute hearing, the Supreme Court also heard arguments on six other cases representing Christian colleges, ministries, and businesses.
The Little Sisters, a group of nuns dedicated to serving the elderly poor, argues that the ObamaCare mandate violates their free exercise rights under the Religious Freedom Restoration Act (RFRA).
The Little Sisters of the Poor and
many other religious nonprofit organizations cannot and will not
participate in killing innocent children. The federal government should
never force Christian ministries to violate their faith. The Obama
Administration's HHS mandate compels the Little Sisters of the Poor to
act against their sincerely held religious beliefs or face crippling
fines that would end their ministry. The Court must reaffirm
America's historic commitment to religious liberty, or it will restrict
our free exercise for decades to come.
Following the hearing, the Catholic Association issued this statement, "Justice Kennedy and Chief Justice Roberts suggested that the government was 'hijacking' the healthcare plan of the Little Sisters of the Poor to advance its agenda. That's exactly what they are doing."

The overtly partisan passage of ObamaCare opened the floodgates for many of the Obama administration's assaults on our First Amendment rights. With the law's passage, we saw that the Obama administration intended to advance its radical agenda at the expense of constitutional principles.
Today's case again brings into focus the importance of replacing Justice Scalia with a Justice who will adhere to the original meaning of the Constitution. If the Court splits 4-4, then there is no final decision. That would mean the Christian groups, including the Little Sisters of the Poor, will in essence lose. In the event the Court evenly splits, the Justices could also decide to rehear the cases when Justice Scalia's seat is filled.
Liberty Counsel and our sister organization, Liberty Counsel Action, strongly oppose President Obama's nomination of Judge Merrick Garland to the Supreme Court. We support efforts to defeat the nomination of any potential Justice who will sway the Court to the Left.
