Der Fuhrer Obama
It
drives the left nuts when we conservatives point out that Obama wants
to be a dictator and tries to act like a dictator. It also angers them
when we point out that liberals would prefer a dictatorship.
If
anyone has any doubt now that Obama is at least trying to act like a
dictator, that doubt should all be removed. The precedent he has
established is dangerous and unless the Republicans act to stop him, it
could threaten the very Constitutional foundations of this Republic.
What has he done now?
The
Obama Regime issued a new policy Friday, just in time for the Friday
evening news black hole, telling Immigration and Customs Enforcement
officials not to arrest or deport the parents of minor children.
Let’s
ignore the policy implications of this for a moment. It is just
creeping, defacto Amnesty. But where does Barack Obama get the
authority to decree that certain parts of the law are simply not going
to be enforced?
The answer is, it comes from the monumental ego of Barack Obama.
There
is no legal authority for the Obama dictator to tell Immigration and
Customs Enforcement officers not to do their job. There is no authority
for him to order the Department of Justice to use “prosecutorial
discretion” on a wide range of people. There are already legal
provisions for asylum and other types of requests to stay in this
country.
No, Obama wants to dictate.
This isn’t the first time he has done this.
He
has done this with Obamacare, delaying unpopular provisions of this law
until after the 2014 elections so that the Democrats will not be
slaughtered at the polls.
In
statutory construction there are two important terms that are used.
The first is called discretionary and the second is mandatory.
Discretionary terms are terms like “May” or “is authorized.” This gives
the Executive Branch the authority to do something. Mandatory language
is boiled down to single word, “shall.”
When the word “shall” applies in a law, the parties the law applies to have no choice. The law must be followed.
The
Obamacare law says the law “shall” go into effect on January 1, 2014.
There is no discretion there. There is no provision of the law that
allows the Dear Leader to modify or change the law.
But that is not stopping Obama.
That is also not stopping the Republicans from going into the fetal position so they can preemptively surrender.
This weekend is the 50th Anniversary
of the Martin Luther King, “I have a dream” speech. Among other things
seen at the rallies put on by the far left as they hijack Dr. King’s
legacy, was the “United States of Obama” Flag. This is an American flag
where the field of white stars has been replaced by a portrait of
Obama.
Perhaps nothing else shows what kind of danger we face today.
Obama acts like a dictator and there is a large section of America that is happy with that.
It
is not too alarmist to ask the question, where does this end? What are
Obama’s limits? If he is willing to ignore the laws Congress passed
and he signed, what else is he willing to do? Perhaps the 22nd Amendment
is something else he would like to ignore. After all, he is Obama and
the Constitution is just a piece of paper. If he wants to run for a
third term why should something like the Constitution stop him?
What
if he wants to just unilaterally extend his second term for ten years?
After all, it is only a rule written on an old piece of paper that says
presidential terms are four years.
Are those extreme examples?
Perhaps.
But if a President is willing to ignore the law, where does his ambition and power stop?
Our
Founding Fathers understood the threat of consolidated, executive
power. That is why they created a weak chief executive. Unfortunately
for America, we now have a chief executive with delusions of
dictatorship and the powers that are supposed to balance the executive
branch have gone AWOL.
We should all be very worried.
