The Unseen threat of an Article V Convention

 

The attached was written by Joanna Martin, aka Publius Huldah, regarding the push for an Article V Convention by the group, Convention of States (COS).  Below is information which will help the reader understand why an Article V Convention is a really, really, really bad idea.

 

So why is COS pushing for an Article V Convention?  Mark Meckler, founder of COS, will tell you that people like Sean Hannity, Mark Levin, Ron DeSantis, Pete Hegseth, and Greg Abbott support the COS.  But do not be fooled by that claim.  Look at who Mark Meckler, COS founder, is also associated with. 


 

The Five Facts

On September 22, 1786 political figures, including James Madison and Alexander Hamilton, met in Annapolis due to the inadequacies of the Articles of Confederation; the result  was a call for the  Continental Congress (then situated in New York) to call a convention; https://teachingamericanhistory.org/document/annapolis-convention-resolution/

The conention was convened on May 2, 1787 in Philadelphis as set by the Continental Congress

 

All of the above went according to plan.  What happened next, however, did not …

 

The delegates, once the convention was convened,

set aside their instructions,

set aside the Articles of Confederation, and

wrote a new constitution, what we know as the U.S. Constitution

The new constitution had its own method of ratification (Article VII), as did the Articles of Confederation (Article XIII) before it.

There is nothing to stop any of this from happening again, if an Article V Convention is called.

 

Article V, U.S. Constitution

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

 

Claims of Meckler’s COS

What happened in 1786/1787 isn’t relevant, for various asundry reasons. False.  There is nothing to stop what happened in 1787 from happening again.  Once a convention is convened, the delegates control what happens there.  Not the states, not Congress.

Any new governing document would have to be ratified by 34 of the 59 states.  False.  Any new governing document would have it’s own method of ratification, as did the Articles of Confederation (Article XIII) and the U.S. Constitution (Article VII)

With all the leaders of the conservative community supporting it; they would not steer is wrong.  False.  There is consent; then there is informed consent.

The Marxist left is against an Article V Convention; therefore, conservatives should support it.  False.  George Soros funds over 630 organizations and groups that support an Article V Convention.

Mark Meckler is a conservative.  Is he?  COS does not disclose who funds the cause.  For all we know, it could be George Soros funding COS.  And what about Meckler’s association with individuals linked to Marxist left groups?  (See below)

Constitutional Amendments:

The first Ten Amendments to the U.S. Constitution are the greatest number added at one time.  These amendments were passed by Congress, ratified by the states, in 1789.  This is also how the next seventeen amendments to the U.S. Constitution were added, showing that an Article V Convention is not really needed unless, of course, the true goal of calling an Article V Convention is not being revealed.

In similar fashion, here is another seminar/conference at which Lessig and Meckler teamed up to argue for an Article V Convention in opposition to David Super and Walter Olson, colleague of the late Herb Titus (https://today.law.harvard.edu/lessig-ponders-the-role-of-a-constitutional-convention-video/)

In November 2021, Meckler met with Pennsylvania lawmakers to push SR 152, the Pennsylvania application, to Congress, for an Article V Convention. During that meeting, Meckler told the lawmakers that Professor Robbie George, Princeton University, is on his Legal Advisory Board.

Who is Robbie George? Well, he was on the National Constitution Center's Constitution Drafting Project.  As part of their work for this quasi-government entity, they drafted a new Constitution that, among other things, restricts the right of the People to keep and bear arms.

George Soros:

In 2005, George Soros brought a group of Marxists together to rewrite the U.S. Constitution and implement it by 2020. Thankfully, that did not happen. It is also a good example of why an Article V Convention, which cannot be controlled once convened, is not in the best interest of our freedom.

Granted, while what COS is pushing to be addressed at an Article V Convention, and what the Marxist left is pushing to be addressed at an Article V Convention, do not jibe in any way, such simply highlights one of the problems of an Article V Convention – both sides would be clamoring to be chosen to represent their state.  Since the delegates make their own rules, decide the agenda, decide what will be discussed, it’s easy to see how the present U.S. Constitution, inclusive of Article V, could be set aside and a new governing document produced; say, one more friendly to the globalist agenda.  Ask yourself how many Americans …

It is telling that many of those supporting the Convention of States group ignore the danger they are putting our freedom in. It is also telling that most have no clue that any power, no specifically enumerated to the general government, via the U.S. constitution, is reserved to the states or the people (Tenth Amendment); that the states or the people have the inherent God-given right to nullify and hold void general government overreach.  We are watching it in action with Governor Ron DeSantis in Florida. It amazing that they don’t seem to find it the least bit concerning that Governor DeSantis is the only Republican governor who seems to understand that he has the inherent power and authority to do this.  The relentless attacks, on Governor DeSantis by the Pravda Media and Biden Regime are because they want to discourage anyone, who understands the concept of nullification, from joining in.

What mechanism is in place to control what delegates do once an Article V Convention is convened?

What is to stop delegates from doing what they did, in 1787, when they set aside their state issued instructions to "amend the Articles of Confederation", set aside the Articles of Confederation instead of amending them; and wrote the U.S. Constitution?
