The Bertrand Report The War For Our Mind & Soul Continues
Ed Note:
U.S. Attorney John W. Huber
"John W. Huber has served as the United States Attorney and lead federal law enforcement official in Utah since June 2015. He served for almost two years as a presidentially appointed U.S. Attorney during the Obama Administration. U.S. Attorney General Jeff Sessions appointed Mr. Huber to continue his service as the U.S Attorney in Utah in March 2017. In August 2017, the United States Senate unanimously confirmed President Donald J. Trump’s appointment of Mr. Huber to serve an additional four years as United States Attorney."
John Huber was an Obama appointee February 2015, then removed by President Trump in March 2017 and recently brought back into the government as interim U.S. Attorney under the "Federal Vacancies Reform Act of 1998" by AG Jeff Sessions and then as an appointee by President Trump June 2017. (WHY???)
Did AG Sessions know back when that he would assign Huber the Clinton email scandal investigation? Is it possible this is being done with Trump's approval and the "ace card" is still up Trump's sleeve? AG Sessions continues to deny the many requests by Congress for a "2nd Special Counsel." (Why???)
AG Sessions appointed John Huber as Utah's U.S. Attorney under an obscured act called the "Federal Vacancies Reform Act of 1998" followed by President Trump's request to keep him on the job. So...what's up with that appointment, a former Obama holdover now going after the FBI / DoJ and Hillary Clinton?
The "Federal Vacancies Reform Act of 1998" (Four Constitutional Problems) The question raised....is the "Act" by which the Senate can surround and infiltrate the Trump Administration with questionable staff and appointees?
"The act allows the Senate to confirm or reject people whom the president never officially nominated. The act allows the Senate to treat a president's written notice of intent to nominate as a nomination, despite the fact that the president has yet to and may never nominate the named individual to an advice and consent position. Such treatment of a president's written notice of intent to nominate violates both the “formalist” and “functionalist” Supreme Court decisions on federal appointment issues."
"The act gives the Senate an impermissible role in making recess appointments. This second constitutional flaw is that it illegitimately interferes with the president's exercise of constitutional authority to make recess appointments."
"The act encroaches on the president's ability to nominate and control subordinate executive officers. It obligates each agency head to report any vacancy, temporary appointment, or official nomination directly and immediately to Congress, without clearance from the President."
"The act transfers too much of the Senate's power in the appointment process to the president in the year following a presidential transition. The act authorizes a newly elected president to appoint acting officers to every advice and consent position in the executive branch for up to 300 days after either inauguration day or the date on which the vacancy occurred. The act permits newly elected presidents to engage independently in precisely the kind of favoritism the framers sought to prevent, it is unconstitutional."
Hillary Clinton et al are facing "Espionage" charges and "Spoilation of Evidence," not to mention money laundering and violations of the Logan Act, but what remains to be seen, can John Huber be impartial while going after FBI and DoJ heads at the same time for political corruption? Hillary Clinton destroyed over 30,000 subpoenaed emails, bleach washed her hard-drives, and the FBI gave her permission to actually slam cellphones and iPads with hammers no less ! Note: Don't try this at home when emails and computers are requested by law enforcement unless you want to be sent away for many years.
There are a host of "statute of limitations" on various crimes committed and one criminal that should have faced the music is former DNI Clapper for lying to Congress, but the statute of limitations ran out recently. He walked away from that hammer, but if AG Sessions and President Trump do not act soon, they will all walk.
President Trump is either working behind the scenes with AG Jeff Sessions, as insider "Q" continues to post, "Trust Sessions" we have to be vigilant and continue to put pressure on Trump and Congressional Leaders to stop the nonsense and get down to business wrapping-up the real traitorous criminals.
If lawlessness continues to be a common theme in our federal government and we do not see justice this year, then all respect for federal law enforcement and this president will become nil.
Personally....I DO NOT trust AG Jeff Sessions. The DoJ is a bit above his pay grade.

U.S. prosecutor reviewing Republican complaints against FBI: Sessions
By Sarah N. Lynch
WASHINGTON (Reuters) - U.S. Attorney General Jeff Sessions revealed that Utah's top federal prosecutor is investigating a variety of Republican allegations of misconduct at the Justice Department and Federal Bureau of Investigation, according to a letter to lawmakers released on Thursday.
However, Sessions stopped short of appointing a second special counsel, despite repeated requests by Republican lawmakers to do so, saying he wanted to wait for the results of the review from John Huber, the U.S. Attorney for the District of Utah.
Democrats in Congress have repeatedly criticized Republican requests for a special counsel, saying they are merely a tactic to distract from and undermine Special Counsel Robert Mueller's ongoing probe into Russian interference in the 2016 election.
Huber's review covers a wide range of issues that Republicans have complained about since last year, from how the FBI handled investigations related to Hillary Clinton, to claims that the FBI made missteps when it sought a warrant to conduct surveillance on a former adviser to Donald Trump's 2016 election campaign.
Sessions' announcement on Huber comes just one day after the Justice Department's inspector general revealed that he too would be reviewing whether the FBI and Justice Department followed the law when they applied for the surveillance warrant on Carter Page, who briefly served as a national security adviser to Trump's campaign.
A Justice Department spokesman said Huber first began investigating various claims in the fall of 2017.
"Mr. Huber is conducting his work from outside the Washington, D.C. area and in cooperation with the inspector general," Sessions wrote to Senator Charles Grassley, Congressman Bob Goodlatte and Congressman Trey Gowdy, who all chair committees that are conducting probes into alleged FBI abuses.
He added: "I receive regular updates from Mr. Huber and upon the conclusion of his review, will receive recommendations as to whether ... any matters merit the appointment of a Special Counsel."
