On April 30, 2015, Judicial Watch sued former Secretary John Kerry after the State Department failed to take action on a letter sent to Kerry “notifying him of the unlawful removal of the Clinton emails and requesting that he initiate enforcement action pursuant to the [Federal Records Act],” including working through the Attorney General to recover the emails. After initially being dismissed by the district court, Judicial Watch’s lawsuit was revived on appeal by the U.S. Court of Appeals for the District of Columbia Circuit on December 27, 2016. The Federal Records Act states that an agency head “shall” initiate an action through the Attorney General when he becomes aware of any unlawful removal of agency records.

Judge orders feds to release details of Clinton email probe after FBI refused request

A federal judge ordered the FBI on Thursday to disclose more details about how it handled its investigation into Hillary Clinton’s secret email account. U.S. District Judge James E. Boasberg said court papers describing the grand jury subpoenas the FBI obtained to compel information from Mrs. Clinton’s internet service providers can be made public.

Judge Orders FBI to Release Unredacted Subpoenas From Clinton Investigation

A federal judge has ordered the FBI to release new details regarding the subpoenas the bureau issued during the investigation into Hillary Clinton's private email server. On Thursday, James Boasberg, a judge for the U.S. District Court for the District of Columbia, ruled in favor of watchdog groups Cause of Action and Judicial Watch, which are suing the government for failing to properly preserve the former secretary of state and failed presidential candidate's emails.
