If the Fifth Circuit does indeed block the injunction, that would not be a ruling on the merits of the case. The merits of the case are not yet being ruled on here... It would just take us back to the status quo that allows Obama to go ahead with the implementation of his amnesty decree, and that would take us right where we are back to the Senate, the only place this can really be stopped.   LINK
