American Conservative, On Tuesday, a federal judge said that the National Security Agency's widespread, unwarranted surveillance violates the Fourth Amendment to the Constitution! U.S. District Court Judge Richard Leon said that the federal agency's actions are incompatible with the Fourth Amendment's ban on unreasonable government searches and seizures. In his 68-page opinion, Judge Leon wrote: "I cannot imagine a more 'indiscriminate' and 'arbitrary invasion' than this systematic and high-tech collection and retention of personal data on virtually every single citizen for purposes of querying it and analyzing it without judicial approval. ... "Surely, [the NSA] program infringes on 'that degree of privacy' that the Founders enshrined in the Fourth Amendment. Indeed, I have little doubt that the author of our Constitution, James Madison, who cautioned us to beware 'the abridgment of freedom of the people by gradual and silent encroachments by those in power' would be aghast." "We have to make a balance between security and civil liberties," says Sensenbrenner. "And the reason the intelligence community has gotten itself into such trouble is they apparently do not see why civil liberties have got to be protected." Sensenbrenner told the National Journal: "The NSA has gone far beyond the intent of the Patriot Act, particularly in the accumulation and storage of metadata. The good news is, since the Amash-Conyers effort to restrain the NSA failed on a razor-thin line in July - 217 to 205 - more legislators on both sides of the aisle are seeing that we desperately need to rein in the federal government and its ability to spy on anyone using the internet or a cell phone literally anywhere in the world.
