It's Official: Elena Kagan Lied!
And when senators broadened the question and asked her if she had ever been asked her opinion regarding any other legal issues that may arise from ObamaCare, she lied yet again and said "No."
She's not just a liar, she's a serial liar. As a matter of fact, released memos that were obtained under a Freedom of Information Act request clearly show that Kagan, as the younger generation would say, was knee-deep in the Kool-Aid.
And yet, the only openly socialist justice on the United States Supreme Court is still refusing to recuse herself from the ObamaCare hearing that is coming before the Supreme Court.
She won't go willingly and, as we expected from the very day she was appointed, she was put on the Supreme Court to give a rubber-stamp of approval to the radical Obama agenda.
It's no secret. The fact that she lied is no secret. The fact that she refuses to recuse herself is no secret.
If given the chance, she'll protect her precious and unconstitutional ObamaCare law like a she-wolf protects her cubs... that's her purpose... her raison d'etre.
The highest court in the land is being stained by a lawless socialist extremist and it is no secret. Asking her to recuse herself is NOT ENOUGH. If this great nation is to remain a nation of laws, Elena Kagan must be impeached... and the sooner, the better.

But Wait A Minute. It Gets Worse.
When Republicans in Congress asked Eric Holder (another official in the Obama Regime who is begging for impeachment) to hand over documents that would only further verify what is already painfully obvious (namely that Kagan lied), Holder REFUSED.
According to the left-leaning Politico.com, Holder initially said that he "has constitutional separation of powers concerns about providing Republicans documents detailing Supreme Court Justice Elena Kagan’s role in defending the health law when she was in the administration."
Put another way, as far as Holder and Kagan are concerned, there are laws for them and laws for the rest of us, and those who are in power don't have to concern themselves with obeying the pesky little laws that the rest of us must obey. They are beyond the law!
In a pig's eye. There's only one way to deal with such LAWLESSNESS!
It's time to explain to our so-called elected officials that evil does indeed thrive when good men do nothing and simply joining the Hallelujah Chorus by calling on Kagan to recuse herself is indeed, "NEXT TO NOTHING!"
They should instead, tell Kagan, in no uncertain terms: 'Your refusal to recuse yourself is a violation of the law and an impeachable offense. Recuse yourself today, or we will draw up Articles of Impeachment tomorrow.'

Yes: Kagan's Refusal To Recuse Herself Is A Clear Violation Of The Law.
Federal law (28 U.S.C., Section 455) specifically reads: "Any JUSTICE, judge, or magistrate judge of the United States SHALL disqualify himself in any proceeding in which his impartiality might reasonably be questioned." [Emphasis Ours]
Furthermore, the statute also states that a judge shall recuse himself: "Where he has served in governmental employment and in such capacity participated as counsel, adviser or material witness concerning the proceeding or expressed an opinion concerning the merits of the particular case in controversy."
There's no wiggle room here. The law does not state that a judge "should consider," or "ponder" or "think about" recusal. The law states that a justice "shall disqualify" himself... PERIOD!
And long before then-Solicitor-General Kagan was even aware that she was being considered for a nomination to the bench of the highest court of the land, she spearheaded efforts, in her capacity as Solicitor-General, to formulate the Obama Administration's rebuttals to legal challenges against ObamaCare.
Political commentator Dick Morris says: "As Solicitor-General, Kagan was the point person for defending the constitutionality of federal law before the Supreme Court. She was, in effect, the lawyer supporting the Health Care law. How can she now sit in judgment on it?"
Former Speaker of the House Newt Gingrich also expressed outrage: "It is unconscionable that a person who actually advised in the writing of Obamacare will now sit in judgment on what they help write. I think clearly Kagan should recuse herself. It's clearly a conflict of interest."
It's much more than "unconscionable." Kagan's refusal is LAWLESS. Why won't our Washington elites simply come out and say as much?
There's no nuance here. There's no way for Kagan to "lawyer" her way out of it. Kagan MUST recuse herself or she MUST BE IMPEACHED and any excuse our elected officials may use not to follow through on the latter is nothing more than fecklessness and cowardice; and it's high time our elected officials understand that the American people are sick and tired of their fecklessness and cowardice.
Again, Mr. McConnell, Mr. Boehner and our elected officials in the House and Senate must be told that you will accept nothing less than Kagan's recusal today or her IMPEACHMENT tomorrow, and the time to send that message is right now.

Did Kagan Commit Perjury?
According to CNSNews: "White House Press Secretary Carney indicated today that Kagan had asked and answered all questions relevant to recusal at her confirmation hearings in 2010." And therein lies the rub.
CNSNews again: "During her confirmation process, Republicans on the Senate Judiciary Committee asked Kagan in writing if she had ever been asked or offered her opinion 'regarding the underlying legal or constitutional issues related to any proposed health care legislation… or the underlying legal or constitutional issues related to potential litigation resulting from such legislation.' Kagan replied in writing, 'No.'"
Carney is right. Kagan answered those questions... and SHE LIED. Unless, of course, the meaning of the word "no" is now to be questioned. Then again, perhaps Kagan and Obama's minions actually think that the American people will believe that the Solicitor-General (before being nominated for a seat on the high court) would NOT have "offered her opinion 'regarding the underlying legal or constitutional issues related to any proposed health care legislation....'" even though doing so WAS HER JOB!
Actually, recent emails obtained from a Freedom of Information Act request clearly show that Kagan did more than "offer her opinion." She expressed outright enthusiasm over the passage of ObamaCare!
In an email interchange with Lawrence Tribe (the subject line of the emails read: "Re: fingers and toes crossed today!"), Kagan exclaimed: "I hear they have the votes Larry!! Simply amazing." Kagan's enthusiasm over ObamaCare apparently necessitated TWO EXCLAMATION POINTS. You can almost envision her bouncing up and down in her chair as she fired off that missive.
Here's an even more damning email interchange reported by NewsMax. It's long, but the bread-crumbs are not hard to follow. The passage below shows that Kagan was clearly involved in formulating strategies to defend the constitutionality (and we use that term loosely) of ObamaCare and her written testimony to Congress during her confirmation hearing, stating otherwise, was clearly a LIE!
| "In perhaps the most damaging email chain from January 2010, two weeks before Obamacare was passed by the Senate, Brian Hauck, the senior counsel to Associate Attorney General Tom Perelli wrote to Kagan’s deputy Neal Katyal, saying that Perelli wanted 'to put together a group to get thinking about how to defend against the inevitable challenges to the health care proposals that are pending.'” "Katyal immediately replied, 'Absolutely right on. Let’s crush them. I’ll speak to Elena and designate someone,' and forwarded Hauck’s email to Kagan with a note saying, 'I am happy to do this if you are ok with it.' "Within minutes Kagan responded, 'You should do it.' And Katyal, who went on to become acting solicitor general after Kagan was elevated to the Supreme Court, emailed Hauck saying, 'Brian, Elena would definitely like OSG (Office of the Solicitor General) to be involved in this set of issues.'” "He told Hauck 'I will handle this myself,' along with an assistant 'and will bring in Elena as needed.'” |
And there it is. It can not be any clearer. Email interchanges clear show that KAGAN LIED during her confirmation hearings for her seat on the Supreme Court and will now sit in judgment over the constitutionality of ObamaCare - even though she was instrumental in formulating the legal strategies to defend that unconstitutional law before the Supreme Court - unless our elected officials in Congress actually decide to do something really wacky and uphold the rule of law.
Be certain, our elected officials will likely attempt to throw some red-meat to the base... they'll express feigned outrage... they'll call for dog-and-pony "investigations" ... they'll flail and gnash their teeth and express their "disgust."
Don't let them get away with it.... It's not enough. No investigation is needed. Kagan's lawless actions are clear and their actions should be clear. Kagan must recuse herself today or they must draw up Articles of Impeachment tomorrow.
