Joe Biden thought he could get away with it.

And Joe Biden got called out for making this illegal Supreme Court move.

 

During the 2020 election, Joe Biden refused to say if he supported or opposed packing the Supreme Court with additional left-wing Justices.

Democrats ramped up their pressure on Court packing when the GOP-led Senate confirmed Amy Coney Barrett to replace the late Ruth Bader Ginsberg in the run up to Election Day.

Enraged Democrats like Alexandria Ocasio-Cortez claimed that with the Court titled six to three in favor of Republican-appointed Justices, the Democrats needed to ram through legislation expanding the Supreme Court by adding as many as six new left-wing Justices.

Now Biden appears to be putting in place a backdoor scheme to pack the Supreme Court.

 

Joe Biden signed the official papers commissioning Ketanji Brown Jackson to the Supreme Court, despite the fact that the Justice who Jackson is replacing – Stephen Breyer – has not officially stepped down from the Court.

Senate Minority Leader Mitch McConnell slammed Biden for adding another Justice to the Court without there being a vacancy.

“President Biden seems to think that Stephen Breyer and Ketanji Brown Jackson are both duly appointed Associate Justices occupying one seat simultaneously. Obviously that is false. And the Biden Department of Justice’s slapdash memorandum raises more questions than it answers,” McConnell stated.

 

McConnell argued the Biden administration is now eliminating the norm of nine Justices by establishing a precedent whereby the President can add Justices to the Supreme Court before a seat actually opens up.

“Whether this is just incompetence or some hair-brained scheme, the same President who set up a Court-packing commission is continuing to erode norms and our institutions,” McConnell added.

McConnell also demanded that Biden publicly announce there are still only eight Justices on the Court saying “the President, the Attorney General, and the Chief Justice should publicly clarify that the Court has eight Associate Justices and one Chief Justice, notwithstanding the administration’s claims.”

In a statement to Fox News, White House Deputy Press Secretary Andrew Bates sidestepped around McConnell’s demand.

“Following her bipartisan confirmation, Judge Jackson remains on the U.S. Court of Appeals for the D.C. Circuit and will become an Associate Justice on the Supreme Court when Justice Breyer steps down at the end of this term and she takes the oaths of office,” Bates statement read. “Unless Sen. McConnell knows something we do not, none of the other eight Justices have announced that they plan to retire.”

“The President has not and will not name additional Supreme Court nominees unless that changes,” Bates concluded.

Democrats want to pack the Supreme Court.

Calls for Court packing will only increase when the Supreme Court hands down its decision this June overturning or greatly curtailing Roe v. Wade.

And the Biden administration not only does not want to denounce Court packing, but it wants to plant the seeds for an eventual Court-packing scheme.
