AFTER LOUSIANA ABORTION CASE
When the Supreme Court struck down the Louisiana Hospital Admitting Privileges Requirement in June Medical Services, - with The Moral Outcry Brief, we were disappointed at first. But since then, because Justice Roberts' concurrence was so strictly limited to that case only, and because it rejected some prior liberal reasoning, we have had four major victories on the pro-life side since then.
LOUISIANA
1. The first thing that happened was the actual Louisiana abortionists, June Medical Services, dropped another lawsuit against the state of Louisiana attacking other regulations. They voluntarily dismissed their case because they felt they would lose the case.
INDIANA
2. Then the Supreme Court reversed a decision of the 7th Circuit Court of Appeals striking down an Indiana sonogram law. They sent the case back to the 7th Circuit Court of Appeals for review in light of Justice Roberts' concurrence in June Medical Services.
3. As we were preparing to file a brief on the above Indiana Sonogram case on behalf of The Moral Outcry Petition and Women Injured By Abortion, the abortionists indicated that they were voluntarily dismissing their lawsuit and allowing the Indiana Sonogram law to go into effect. Wow!
ARKANSAS
4. In another case, the 8th Circuit Court of Appeals upheld an Arkansas law prohibiting abortions on the basis of racial, sex or disability discrimination and requiring the child to be buried with human dignity rather than treated as waste.
WHEN IS A LOSS NOT A LOSS?
As I said before June Medical Services was decided, any victory was going to be a great victory because the abortion industry expected to strike down every abortion facility regulation in the country. Their strategy if they had won was called the "Big Fix." Instead they have been beaten back and beaten back. We must continue the battle. The Moral Outcry Petition is a multi-phase, persistent strategy to file briefs at the Court until its abortion cases are all reversed.
