UPDATE: HEARING YOU, more lawmakers are demanding answers from the Obama administration about ICE Acting Director John Sandweg's sketchy background, competency and vetting for the position.
Sandweg's 'qualifications' – or lack thereof – make him INELIGIBLE to serve as permanent director… why is he "Acting Director" with all the same authority, in violation of federal law?
Lawmakers are arguing that this is yet another Obama end run around the rules, regulations and professional requirements for highly sensitive Acting AND Permanent Director positions, in order to further Obama's hyper-politicization of the Department of Homeland Security – with a special focus on Border Security and Immigrations and Customs Enforcement.
Obama's law-breaking at the DHS and ICE MUST NOT CONTINUE!

Napolitano is GONE, now it's up to us to demand a TRUE BORDER SECURITY PROFESSIONAL TO REPLACE HER AND HER UNDERLING JOHN MORTON!
Sandweg, a Napolitano fundraising hack boot-licker from Arizona, falls far short of the five-year minimum law enforcement professional experience requirement outlined in the Department's own rules and regulations for the Permanent Director position… the rules are not explicit on whether those requirements pertain to the Acting level but Congress is rightly SKEPTICAL that this pol has ANY business in the post.
One source told FoxNews.com that despite all of the reorganizing and renaming under the Bush administration, it was certainly the intent that the same rules would apply to either level in order to prevent the indefinite installation of an acting director to get around the job requirements.
The 2002 law which established Immigrations and Customs Enforcement, then known as Bureau of Border Security, specifically requires that the director "shall have a minimum of 5 years professional experience in law enforcement, and a minimum of 5 years of management experience."
Sandweg has ZILCH years of law enforcement experience. Even considering his servile political-minion tenure at the DHS under Napolitano, he would still fall short.
One thing for certain, however, is that the Obama administration has no regard for FOLLOWING or ENFORCING LAW that it does not like or that it believes is not in its best interest – and unless Congress holds them to it the law will be violated!

Rumor is that none other than the disgraced Obama-hack director of Immigration and Customs Enforcement (ICE) – JOHN MORTON – is a front-runner.
In fact, Morton has already been replaced as ICE Director with the elevation of just-as-awful John Sandweg as acting director.

Here's what you need to know about John Sandweg as we move forward in the fight for SECURE BORDERS:
He's a former criminal defense attorney who represented accused and convicted murderers, sex offenders and pedophiles. Sandweg fought for the release of violent convicted offenders between 2002 and 2009 in Arizona. He also helped then-governor Janet Napolitano raise oodles of campaign cash.
It is blind and unblinking loyalty, ideological purity, and politics first that pays off professionally in the Obama era!
While at DHS, Sandweg sat on a panel called "Hoping for Change – Administration Relief under the Obama Administration" at the 2011 National Immigration Center's Low-Income Immigrants' Rights Conference.
"Provides an overview of the tools available to the Obama Administration to grant relief to undocumented immigrants," read a pamphlet describing the panel discussion. "Covers the various campaigns to seek administrative changes to the federal immigration system, including efforts to de-link the criminal justice and immigration enforcement systems, secure deferred action for DREAM-eligible youth, and allow for adjustment of status of individuals who qualify for family visas. Participants strategize about the best opportunities for seeking administrative relief in 2012."
Within DHS, Sandweg's 'promotion' has been met with disgust and disbelief…
"He has zero law enforcement experience and he [is running] our country's second-largest law enforcement agency – and that's a real job, it's not a figure-head position," a former administration official said. Napolitano maintains he's the man for the job of overseeing more than 20,000 employees throughout the U.S. and in 47 foreign countries in the pursuit of enforcing immigration law.
"Since joining DHS in 2009, John has served as one of my closest advisors on matters related to immigration enforcement, border security, and federal law enforcement," Napolitano wrote. "John brings significant experience in the development and implementation of our border security and immigration enforcement strategies and will continue to build on our common sense approach that prioritizes public safety and national security."
At least SOME on Capitol Hill are as worried as they should be…
"I am deeply disappointed by this appointment and believe it is disrespectful to the thousands of dedicated professionals at ICE who are working tirelessly to enforce our laws and provide for our security," said Rep. "Judge" John Carter, (R-TX), chair of the House Homeland Security Appropriations Subcommittee. "I urge the administration to re-think this appointment and promptly appoint a qualified, confirmable applicant for this essential post."
Fox News reports:
According to a scathing 2011 report prepared for Rep. Darrell Issa, R-Calif., the chairman of the House Committee on Oversight and Government Reform, documents showed Sandweg – then senior adviser to Napolitano and the top political appointee in her inner circle – was "responsible for halting releases on behalf of the [Office of the General Counsel] and the Office of the Secretary."
"The Secretary's political staff failed to recognize that they are servants of the public," the report concluded. "They are entrusted to place the interests of the American people ahead of their own. In the case of FOIA, political appointees were more concerned with protecting themselves from embarrassment than running an effective disclosure program."
The report continues on to blast the group of political appointees involved, saying, "The extent of the mismanagement of the FOIA function at DHS calls into question the competence and commitment of high-level staff charged with protecting the homeland from serious threats."
But that's just about who is going to replace Morton…
As for the Napolitano heir apparent himself, Morton is very likely an even more dangerous, devious and deceitful DHS Secretary pick than Sheila Jackson-Lee!
On June 11, 2010, ICE Union leaders issued a unanimous No Confidence vote in ICE Director John Morton on behalf of their approximately 7,000 ICE officers, agents and employees nationwide, citing "gross mismanagement within the Agency as well as efforts within ICE to create backdoor amnesty through agency policy." ICE Union leaders noted that since the No Confidence vote was released problems within the Agency increased, citing specific actions by Director Morton…
"Any American concerned about immigration needs to brace themselves for what's coming," said Chris Crane, President of the National ICE Council, at the time. "This recent directive [of non-enforcement] is just one of many new ICE policies in queue aimed at stopping the enforcement of U.S. immigration laws in the United States. Unable to pass its immigration agenda through legislation, the Administration is now implementing it through agency policy."
That's right! In June 2010, the ICE union of which Crane is president cast a unanimous 259-0 vote of NO CONFIDENCE in Morton! Yet somehow, Morton remained at the helm of ICE to oversee Obama's blatantly illegal fail-to-enforce agenda at the Immigration and Customs ENFORCEMENT bureau complete with "prosecutorial discretion" to gut our ability to send illegal immigrant criminals HOME!
And who could forget this past spring, when the Obama administration took it upon itself to punish the American people and endanger public safety by RELEASING THOUSANDS of illegal immigrants and FIRING BORDER PATROL AGENTS under phony pretenses of unavoidable sequestration cuts!
In at least partial answer to the travesty of hurting American citizens by emptying federal jails of criminals, Alabama Republicans Rep. Mike Rogers and Sen. Jeff Sessions called for the immediate resignation of ICE Director John Morton. Morton's fundamental FAILURE TO ENFORCE FEDERAL IMMIGRATION LAW – the whole point of his job – was well documented before this latest political stunt!
THE RESIGNATION NEVER HAPPENED – AND NOW HE'S ALL-SET TO GET A REALLY BIG PROMOTION – AS DHS SECRETARY!
"Secretary Napolitano's tenure at the Department of Homeland Security was defined by a consistent disrespect for the rule of law," Sen. Jeff Sessions (R-Al.) said in a statement.
"The resignation of Secretary Napolitano should refocus the attention of Congress on its first task: to ensure that the executive branch faithfully carries out the laws of the land. The most significant obstacle to immigration reform remains President Obama's selective enforcement of the law. Any selection – interim or permanent – to replace Secretary Napolitano must disavow these aggressive non-enforcement directives or there is very little hope for successful immigration reform."
"Whoever replaces Secretary Napolitano must restore the rule of law, as well as the morale of ICE officers which has plummeted under her tenure."
This must be the standard to which ANY appointee is held.
With the Senate – Democrat and RINOs alike – just CONSUMED with selling Obama's Syrian adventurism still trying to foist S. 744 Amnesty onto the House (and using big Silicon Valley donors like Facebook, Google and Microsoft to turn up the pressure), we must keep making our demands known to our Senators so these AWFUL appointments DO NOT SLIP THROUGH during all the distractions!
Since Napolitano's confirmation four years ago, the border has NOT been secured and the terrorist threat NOT minimized while the rule of law has been consistently politicized and undermined.
This cannot continue.
We all know, however, that their political arrogance knows no bounds, as the criminal abuses from the Obama Administration just get more and more blatant!
Napolitano in her resignation speech claims to have "implemented smart steps that make our immigration system more fair and focused while deploying record resources to protect our nation's borders."
Except the only border this administration seems determined to close is our northern one with Sen. Jon Tester (D-Mont.,) announcing that new low-cost, high-tech sensor systems could be installed along the ENTIRE U.S.-Canada border!
Tester says it will be similar to Blue Rose, a fiber-optic based in-ground perimeter defense and detection system developed by the Naval Undersea Warfare. It works by detecting the sound and vibration of intruders near the sensor.
He says it's an opportunity to "save money and help secure the border" without putting "a guard every thousand feet"…
WHERE IS THE SIMILAR EFFORT ON OUR SOUTHERN BORDER?
Here are some numbers to put this phony border security distraction into context:
The U.S.-Mexico border is 1954 miles long; the U.S.-Canada border 3,987 miles EXCLUDING ALASKA!
In 2009, about 7,000 people were caught illegally crossing into the U.S. from Canada.
That same year 541,000 were caught illegally entering the U.S. from Mexico!
Napolitano has previously said with a straight face that her "border enforcement is second to none" and that deportations "will be very robust" at precisely the same time she SHUT DOWN DEPORTATIONS of illegal entrants via "prosecutorial discretion"! Way to deliver the Hispanic vote for the 2012 election, Big Sis.
And now, this new timely resignation is likely in the hopes of chipping away at Republican resistance to further empowering "Big Sis" to ruin border security and undermine law enforcement – but it is still Barack Obama who will be doing the appointing!
Obama's approval numbers with real American voters continues in freefall after his last major executive action decreeing unlawful and unconstitutional forms of administrative Amnesty for illegal aliens. The federal halt to deportations means illegals are now being released from detention and jails – and given work permits.
How can Obama pretend concern for millions of unemployed Americans, talk about creating jobs, demand nearly a half trillion dollars in new debt for another job stimulus – yet hand out hundreds of thousands of work permits and unjust citizenship papers to illegal aliens?
Obama's unlawful and unconstitutional Amnesty orders, and Napolitano's enthusiastic compliance – and likely that of her replacement – will only make a terrible U.S. jobs situation worse!
Jobs and votes aren't all that get stolen from Americans by unchecked illegal immigration. A new government report shows that more than half of all people sentenced to serve time in federal prison for committing felonies are Hispanic, a seismic demographic shift swollen by immigration offenses.
The preliminary U.S. Sentencing Commission shows that for the first time, Hispanics comprised 50.3 percent of all federal offenders in the first nine months of this fiscal year. Sentences for felony immigration crimes, which include illegal border crossing and other crimes such as alien and contraband smuggling, accounted for most of the increase in the number of Hispanics sent to prison over the last decade.
But whoever coined the phrase "crime doesn't pay" could not have anticipated gangster government under Barack Hussein Obama or Janet Napolitano. These two "prove" that old adage wrong as the Obama faction HALTS DEPORTATIONS OF ILLEGALS, instead lays out the welcome mat for illegal incursion, and lavishes upon immigration prisoners a long list of amenities stolen from U.S. taxpayers – including bingo, dance classes, potted plants, and even weekend continental breakfasts – and of course, citizenship classes!
Obama's Amnesty campaign is in full swing, and he just "did the deal" with La Raza (The Race), LULAC and the whole lefty-victim Hispanic lobby – who demanded STOP THE DEPORTATIONS, AND THEY WILL DELIVER THE VOTES, LEGAL AND ILLEGAL FOR GENERATIONS TO COME!
The insanity continues as Obama and his minions like Napolitano throw open wide the southern border separating us from Mexico, and allow untold millions more illegal migrants to flood our towns and cities, gain false "papers" and steal identities, and illegally VOTE. Drug cartels maraud along the border, killing Federal agents, law officers and innocent citizens, and the U.S. Justice Department and our ATF unlawfully provide them with millions of dollars of taxpayer-subsidized weapons! But Obama gains Hispanic constituents, and cares nothing of sinking us deeper into moral and economic ruin – at a cost of $100s of billions per year! Now he wants to reward those who break the law, at the expense of those who uphold it – by HALTING DEPORTATIONS AND HANDING OUT U.S. CITIZENSHIP!
They are even depending on using "border security" as a bargaining chip to do it!
Then there's the violence. In what's been called the U.S.'s "third war," more than 30,000 people have been murdered by Mexican drug cartels on both sides of our southern border. Rather than take decisive action to defend America's sovereign territory from attack by invading foreign forces, our Federal government has instead displayed its cowardice, AND EVEN BEEN COMPLICIT WITH ITS FAILED GUN & DRUG "STING" – THE MORALLY CORRUPT "FAST AND FURIOUS" OPERATION.
In fact, Obama and Napolitano have so completely capitulated to open borders that more than 100 miles north of the border – well into U.S. territory – our government has erected signs warning American citizens to stay out of American lands because of the danger posed by heavily-armed foreign thugs who freely roam thousands of square miles of the United States!
With or without Napolitano at the DHS, America cannot long endure this "Obama effect" before disintegrating in front of our very eyes and plunging us into the darkness of anarchy. We the People must unite and stand tall for the rule of law in the United States. Obama's policies must stop – and today is the perfect opportunity to prove our mettle and our love for our nation, and ACT.
The evidence could not be more damning. The outgoing DHS Secretary is an OBAMA POLITICAL HACK, a menace to America, cares nothing for the Constitution – and her replacement MUST BE VETTED THOROUGHLY AND WITH BORDER SECURITY FIRST IN MIND!
The danger she poses is clear and present. Napolitano, in a now infamous shocking lie, publicly announced that the U.S. southern border is "more secure than ever before" based solely on apprehension and arrest counts. Yet a recent report released by her own DHS states that Homeland Security is only "achieving varying levels of operational control of 44% of the southwest border." It further discloses that only 15% of the 44% is defined as "controlled" – which means less than half of the border is even being Federally monitored, and ONLY a measly 15% of that represents U.S. frontier where illegal alien incursions have a "high probability of apprehension."
In plain English – of the nearly 2,000 miles of border which DHS is tasked to defend, only 129 miles are actually under our government's control. 129 MILES!
Then add to this outrage the new DHS detention policies and budget expenditures already described! This is more than incompetence, this is sabotage. Obama and his administration have failed to lead, failed to protect Americans and failed to uphold their Constitutional oath to enforce the laws of the United States of America. They continue to bold-face lie about it to the public and to Congress. Their betrayals are a threat to the nation and their duplicity directly insults the intelligence, and imperils the safety, security, sovereignty and prosperity of the American people.
WE MUST TELL WASHINGTON WE WILL NOT BE COWED INTO COMPLIANCE WITH THIS DESTRUCTIVE AGENDA, NOR WILL WE GIVE UP OUR FIGHT FOR SECURE BORDERS – NOT EVER!
And why should we, when we are making progress against this stonewalling, elitist snob regime! Obama's popularity numbers are sagging, and America is starting to wake up!
We are facing confirmation for one of the most critical executive positions yet – the one to replace outgoing Department of Homeland Security Secretary Janet Napolitano!
"The selection of her replacement could be the first test of a scaled-back check on the President's power," John Ashbrook, spokesman for McConnell, told The Daily Caller.
That means we need to make our voices heard loud and clear on Capitol Hill BEFORE the for-show-only filibustering leads to confirmation of Big Sis (or Bro) #2 where the Homeland Security Secretary is committed ONLY to the Obama Oval Office and maintaining its political image and agenda above all else!
AND, MAKE NO MISTAKE AMERICA: The release into our neighborhoods of criminals scheduled for deportation, on the pretext of "budget" cuts to immigration enforcement and border security, are nothing but the repercussions of standing up to the Obama regime. And now the Toddler-in-Chief is having a temper tantrum, determined to punish us because he didn't get his way and he has lost political capital over it!
RINO Rubio is even trying to pacify us into submission saying we need to accept the vile and destructive Senate Amnesty-for-all bill or OBAMA WILL FORCE HIS OWN UNMITIGATED BRAND OF AMNESTY ON US… BY FIAT!
THIS IS NOT ACCEPTABLE BEHAVIOR FROM A PRESIDENT OF THE UNITED STATES – AND WE DO NOT HAVE TO PUT UP WITH IT!
Obama needs to learn he is NOT above the law; he cannot simply pick and choose which laws he wishes to follow!
OBAMA MUST BE TAKEN TO TASK FOR HIS TREACHERY, with Morton and Sandweg made examples of for all the Capitol Hill progressives!  THEY MUST LEARN THEY DO HAVE TO ANSWER TO THE RULE OF LAW AND TO WE THE PEOPLE!
Congress has a long week to go in their home districts, pretending that all is well… we need to let them know WE are living with their FAILURES!
