DEMAND THAT KAGAN EITHER RECUSE HERSELF OR BE REMOVED FROM SCOTUS - Section 28 U.S.C. 455

BY LAW KAGAN MUST RECUSE HERSELF

The law, (Section 28 U.S.C. 455) clearly states that a justice "shall disqualify himself in any proceeding in which his impartiality might be reasonably questioned" or "(w)here he has served in governmental employment and in such capacity participated as counsel, adviser or material witness concerning the proceedings…"

Kagan and the DOJ, by claiming attorney client privilege in hiding ObamaCare emails, have inadvertently proven the case for her recusal. She clearly provided legal counsel for the defense of ObamaCare, yet she expects to now rule as a Supreme Court Justice on its Constitutionality.

Sorry Elena, you can't have it both ways. The law must be upheld. Elena Kagan MUST be recused!

Thus far Kagan has failed to recuse herself, and she lied about her active involvement in defending ObamaCare prior to her SCOTUS nomination, further compound the Ethics and Criminal complaints Life & Liberty PAC helped to bring against Kagan during her confirmation process.

Kagan MUST be forced to RECUSE from ObamaCare high court cases! Despite denials by her and her cronies, internal Obama Administration emails and other evidence chains show her partisan involvement in the Department of Justice and White House design, formulation, and deployment of the legal defense of ObamaCare.

ObamaCare is headed to the Supreme Court and it turns out Elena Kagan isn't "unbiased" like the liberals claim. In fact, she's not only partial to ObamaCare, she was elated when it passed.On March 21, 2010 socialist healthcare became law of the land. CNS news reports that then-Solicitor General Elena Kagan and famed Supreme Court litigator and Harvard Law Prof. Laurence Tribe, who was then serving in the Justice Department, had an email exchange in which they discussed ObamaCare. Kagan wrote an email to Tribe and said, "I hear they have the votes, Larry!! Simply amazing." If Kagan isn't recused from the upcoming ObamaCare vote we know how she'll vote.
