As you may recall, the Thomas More Society needed to intervene in the case after Minnesota’s outspokenly pro-abortion Attorney General Keith Ellison failed to raise the state’s best defense.
This was a winning defense – the very same defense Ellison has used successfully in defending against attacks on other (non-abortion) Minnesota laws in the past.
Obviously, this was not inadvertent, a merely negligent mistake.
Ellison’s omission was willful and deliberate.
The state’s own lawyer was essentially throwing the case so the abortion lobby would win, wiping out duly enacted state laws that protected Minnesotans for many years.
But the Trial Judge denied our motion to intervene, even saying (contrary to controlling legal precedents) that the defense Ellison omitted was not valid – even though Ellison himself had raised it and won other (non-abortion) cases where he raised that very same defense.
So, we immediately appealed that horrible decision, again citing the inadequate defense put up by the state’s Attorney General’s office.
But just this week, after the oral argument of our appeal was heard in court, the pro-abortion group, Gender Justice, hurriedly moved for an emergency temporary restraining order against enforcement of all of Minnesota’s common-sense abortion regulations.
This means that all of Minnesota’s laws that regulate abortions are in serious jeopardy and may be overturned in a matter of a few days or perhaps weeks – even before our appeal is decided!
Indeed, all of these pro-life laws that protect families, mothers, and babies could be removed.
Of course, the Thomas More Society is again doing its utmost, urging the Trial Judge to stay his hand, let our appeal proceed to a proper ruling in the usual and ordinary course of judicial proceedings – and letting these laws get a decent, competent, honest defense – and save as many babies as possible.
