Get A More In-Depth Understanding Of Birthright Citizenship And the Constitution
By Edward Erler – Professor of Political Science at California State University, San Bernadino. The Heritage Foundation The following is an entry concerning the first section of Amendment 14 of the Constitution as found in The Heritage Guide to the Constitution. Before the adoption of the Fourteenth Amendment, citizens of the states were automatically considered citizens of the United States. In 1857, the Dred Scott v. Sanford decision had held that no black of African descent (even a freed black) could be a citizen of the United States. The Fourteenth Amendment was thus necessary to overturn Dred Scott and to settle the question of the citizenship of the newly freed slaves. The Civil rights Act of 1866 had previously asserted that “All persons born in the United States and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States.” The immediate impetus for the Fourteenth Amendment was to constitutionalize and validate the Civil rights Act because some had questioned whether the Thirteenth Amendment was a sufficient basis for its constitutionality. A constitutional amendment would also have the advantage of preventing a later unfriendly Congress from repealing it. Read More

Fracking Has Obama’s Bulls Eye Painted On It. EPA targets methane emissions By John Siciliano • 8/18/15 – Washington Examiner The Obama administration announced proposed rules Tuesday that target methane emissions from oil and gas wells that use hydraulic fracturing, or fracking, to produce fossil fuels. Environmental Protection Agency Administrator Gina McCarthy said the rules are part of President Obama’s Climate Action Plan to fight what he considers the growing threat posed by global warming. “Today, through our cost-effective proposed standards, we are underscoring our commitment to reducing the pollution fueling climate change and protecting public health while supporting responsible energy development, transparency and accountability,” McCarthy said. Methane is a potent greenhouse gas that traps heat at a rate 25 times greater than carbon dioxide. It accounts for nearly 10 percent of U.S. emissions and is the biggest unregulated greenhouse gas in the country. Of that total, 30 percent of emissions come from the oil and gas sector, the White House has said. Read More
