S. 3220, the Paycheck Fairness Act (PFA) purports to solve the problem of women earning 77 cents to the dollar that men earn. However, recent studies show that is not the case, in fact, young women in their 20's who have no children and are unmarried actually make 17 cents more per dollar that comparable young men earn.

Senate Democrats are touting this bill and continuing to claim that Republicans are waging a "war on women" for not supporting this deeply flawed legislation.
First off, President Obama and Democrats are constantly reminding us that the first bill they passed after President Obama was inaugurated was the Lilly Ledbetter Act, which was supposed to make unequal pay a thing of the past. They couldn't have solved the problem and still make the claim that women earn less. It's one or the other; either the Lilly Ledbetter Act was a gimmick, or this one is.
Actually, it's both.
PFA makes it very easy for employees to claim gender discrimination, and puts the burden on the employer to prove that the claim is false. That is not how the American justice system is supposed to work. It is the burden of the accuser to prove the accused is guilty. One cannot simply make a claim without real evidence and then sit back and watch as the accused tries to disprove the claim.
But that is exactly what the PFA does.
The bill doesn't even exempt women business owners (which are the fastest growing segment of business starters). Are they just as culpable for discriminating against women when it comes to pay?

But aside from the consequences this law would have on businesses and hiring, the fact of the matter remains that women don't earn less than men when other factors are taken into consideration.
For instance, men are more likely to become engineers or work in dangerous jobs like on oil rigs. Men also tend to work more hours a week, whereas many women work fewer hours in order to care for their children. Obviously some men work less to care for their children and some women don't have kids, but there are enough on each side to make a straight up apples-to-apples comparison flawed.
When all factors are considered, women might earn a few cents less than men, but remember that childless, unmarried women in their 20s earn, on average, 17 cents more per dollar than comparable young men. And since more women are going to college now than men, this statistic will soon be greater.
So the unequal pay that this legislation is supposed to be correcting doesn't even exist!

Senate Democrats are trying to make an issue where this is none. Well, there are parts of the country where women do earn less than men for equal work, one of which is...Senate Democrat offices!
A recent report found that 37 out of the 50 members of the Democrat caucus paid their female staffers less than their male staffers. In fact, 3 of the 5 Democrat Senators that touted the Paycheck Fairness Act - Patty Murray (D-WA), Dianne Feinstein (D-CA) and Barbara Boxer (D-CA) - in fact pay their own female staffers less.
Senator Murray pays her female staffers on average 35.2% less than male staffers. Senator Boxer pays her female staffers 7.3% less and Senator Feinstein pays her female staffers a whopping 41% less than her male staffers. Talk about gender inequality!
And Senate Democrats aren't the only hypocrites, President Obama's female staffers earn about 13% less than his male staffers.
Yet they're trying to bring their brand of equality into the private sector?

P. S. Before Democrats try to tell the rest of the country how to act, they should first make sure their hands are clean. Touting legislation that is supposed to end pay inequality while paying women less than men does not help one's cause.

This bill allows trial lawyers to make big bucks suing for copious amounts of punitive damages due to so-called gender discrimination. And since litigation such as this is basically a lottery - that is, a host of circumstances must align for a winning case (such as the right judge, right victim, etc.) - Senate Democrats are essentially trying to pass a bill that will harm business just to maybe help some victims who may or may not have actually been discriminated against.
If you're sick of trial lawyers wining big while the rest of us suffer, you'll urge your Senator NOT to support the Paycheck Fairness Act.
