Oral arguments were made before a U.S. District Court Judge regarding the countersuit filed in February as a response to the fed's on-going legal challenge to SB 1070 - Arizona's tough as nails crackdown on illegal immigration that has proven effective in detering illegal immigration within the state. Despite the Obama Administration's request that the counterclaim be dismissed, no decision has been issued and AZ Gov. Jan Brewer is confident the case will proceed. Arizona's counterclaim is based on five fundamental points: (i) the federal goverment has failed to gain "operational control of the border," as required by federal law; (ii) failed to enforce federal immigration law; (iii) failed to protect Arizona from harms associated with illegal immigration; (iv) been negligent in reimbursing Arizona for more than $760 million in costs for incarcerating illegal immigrants; (v) sought to pre-empt the state from protecting the health, safety, and welfare of its citizens.
